Panelpolls — Terms and Conditions
Last Updated: 8-1-2026
PLEASE READ THESE TERMS OF USE CAREFULLY BECAUSE THEY DESCRIBE YOUR RIGHTS AND RESPONSIBILITIES, AS WELL AS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER. YOUR USE OF THE SITE OR PARTICIPATION IN PANEL CONSTITUTES YOUR AGREEMENT TO THESE TERMS AND CONDITIONS.
Summary
Panelpolls is a research panel owned and operated by Touchstone Research, Inc. (“TSR”), a U.S. market research company specializing in consumer, youth, and family insights since 1991. Here’s how it works: Adults 18 and older may register individually, and parents and legal guardians may register their household to include children under 18. After registration, all individuals must complete an identity verification process to become active members eligible to receive research invitations and incentives (“Active Members”). For clarity, children are not eligible for individual registration and do not undergo identity verification. Activities are sent by email and participation is voluntary. When you complete a qualifying research activity, you may receive a digital incentive (such as an e-gift card) as described in the invitation. There is no points system, no account balance, and no requirement to log in to a member portal.
This summary is for convenience only. The sections below govern your participation.
Generally
These Terms and Conditions govern your Membership in any of Touchstone Research, Inc.’s (“TSR”) Panels or Communities (as defined below), including without limitation all current and future research Panels or Communities, and/or any other Panel(s) created, maintained and/or operated by TSR and/or its affiliates, subsidiaries and/or divisions (collectively referred to herein as “TSR” “we” or as “us”).
These Terms and Conditions (the “Agreement”) govern your access and use of any TSR panel Website (each a “Website” and collectively the “Websites”), facilities, and participation in the associated online opinion panel, community, and related research activities (the “Panel”). In consideration for your right to access and use the Website and participate in the Panel, you represent that you are eligible to participate and agree to be bound by these Terms and Conditions. By becoming or remaining a Member (as defined below) in the Panel, you represent that you are eligible to participate and you agree to be bound by these Terms and Conditions and any modifications made to them from time to time without further notice. This Panel is operated and managed by TSR and TSR is solely responsible for such and has sole discretion in these matters.
Panelpolls is a research panel operated by TSR where eligible participants (“Panelists” or “Members”) may be invited, primarily via email, to take part in research activities. As a thank-you for their time, Panelists may receive a digital incentive, such as an e-gift card, for qualifying participation as described in the applicable invitation. Participation is voluntary, and there is no guarantee of any minimum number of invitations or incentives. Following completion of registration, individuals must successfully complete identity verification (described below) to become Active Members eligible to receive Activity (defined below) invitations and incentives. References in these Terms and Conditions to “Members” or “Panelists” include both registered individuals and Active Members; specific provisions that apply only to Active Members are identified as such.
These terms and conditions regarding your use of the Site constitute a legally binding agreement between you, the Site, TSR and its Client(s) and any of its parent companies. In this Agreement, the term “Site” includes this Website (defined above) and all web pages within as well as any associated portals or sub-Websites and any equivalent, mirror, replacement, substitute or backup Websites, successor Websites, and web pages. By using this Site, you understand, acknowledge and agree that you will abide by the terms of this Agreement and any additional terms that govern certain products and services, which will be presented in conjunction with those products and services (“Additional Terms”), including the User Content Submission Agreement which governs your submission of User Content as such term is defined therein. The Site may also provide rules of participation (“Rules”) for certain activities and services including, but not limited to, contests and sweepstakes, research incentives (such as e-gift cards issued after completion of qualifying research activities), Membership clubs, email, and community forums or activities and survey research. The Site’s Additional Terms and the Privacy Policy (available at https://touchstoneresearch.com/privacy-policy/) and the Rules are hereby incorporated in this Agreement by reference, as amended from time to time. To the extent that there is a conflict between this Agreement and Additional Terms for the activity in which you choose to participate, the Additional Terms shall govern. To the extent that there is a conflict between this Agreement and the specific Rules for the activity in which you choose to participate, the Rules shall govern. This Agreement will remain in full force and effect as long as you are a user of the Site, participate in TSR research activities, and in the event of termination of any Membership, service or feature, you will still be bound by any of your surviving obligations under this Agreement, the Privacy Policy, any Additional Terms or Rules, as applicable, including any indemnifications, warranties and limitations of liability contained therein.

Acceptance of Terms
By accessing, using, participating in or registering for the Panel, you agree to be bound by these Terms and Conditions and any modifications made to them.
Use of Site
Access to, and use of, the Site is subject to this Agreement, and, except with regard to users that are TSR Clients, is limited to your personal, non-commercial use. Any use of the Site in violation of this Agreement is strictly prohibited. By accessing, using, participating in or registering for the Panel, you become a Panelist or Member of the Panel; such participation is considered “Membership”. Except with regard to users that are TSR Clients, Membership in the Panel is limited to your personal, non-commercial use. Any commercial or other use of the Panel in violation of this Agreement is strictly prohibited.
Each Panel will be open to individuals and households who meet certain eligibility criteria specific to the focus of the Panel. If you do not qualify, please do not attempt to register for Membership in the Panel or participate in a survey or research activity. By participating in the TSR Panel, you represent that you are eligible to participate and agree to be bound by the terms and conditions set forth herein. This Panel is open to adults age 18 years or older who reside in the United States, including parents or legal guardians of children ages 0–17 who may participate as a household with their eligible children, subject to the parental consent and eligibility requirements specific to each activity. Eligibility to become an Active Member, receive Activity invitations, and receive incentives also requires successful completion of the identity verification process described below.
Our registration process, and some surveys or research activities, may require you to accept a cookie from us. For more information about how we use cookies, please refer to our Privacy Policy.
TSR reserves the right to refuse to offer or provide Panel Membership or other services to anyone, at any time, in its sole discretion.
While reasonable care has been taken in respect of the information contained on the Site, neither TSR nor its Client(s) makes any representation or warranty (either express or implied) as to the completeness of the information or its suitability for any particular purpose. Except as expressly provided, the information on the Site is made available to you solely for limited personal and non-commercial use. Management of this Panel
This Panel is owned, operated, and managed by TSR. TSR is solely responsible for such and has sole discretion in these matters.
Limitations of Membership; Non-Transferability
Membership is limited to one account per individual or qualified household with children in the target age range. Multiple individual or household Memberships across multiple email accounts are prohibited and subject to immediate cancellation, and will result in removal from the Panel and forfeiture of any pending or unissued incentives. Membership is specific to the individual with a unique e-mail address and to the individual who registered and completed the demographic and other profile information sections. Incentives (such as e-gift cards) are awarded on a per-activity basis as described in each project invitation and are personal to the Panelist (or, in the case of household memberships, the household registrant). Incentives are not transferable and are not considered property; they cannot be sold, assigned, or otherwise transferred to another individual except as expressly permitted by TSR. Any attempt to transfer an incentive shall be automatically void.
Nothing contained in this section shall be applicable to users who are TSR Clients.
Honest and Accurate Disclosures
You, as a Member of a TSR Panel, agree to provide true and accurate information during the registration process, during identity verification (including any documents, images, or information submitted to TSR or its identity verification provider), while filling out demographic profile information and other general details, and while answering survey research questionnaires or participating in research activities. If you provide any information that is untrue, inaccurate, or not current to TSR or any of its Clients or agents, or if TSR or one of its agents has reasonable grounds to suspect such information is untrue, inaccurate, or not current, TSR has the right to terminate your Membership and refuse any and all current or future access to, or use of, the TSR Site, and to withhold or cancel any incentives associated with fraudulent or invalid participation, provided that if you are participating as a qualified household these actions apply to the household.
Registration & Verification
Registration requires that you provide a valid email address and other contact or demographic information requested by TSR. TSR verifies Panelist information primarily through email and, where applicable, phone verification. TSR reserves the right, however, to request additional information — including a valid physical United States address of residence (PO Boxes are not acceptable when a physical address is requested) — to verify Panelist identity or eligibility, to investigate suspected fraud or duplicate participation, or to comply with tax or other legal reporting obligations. TSR reserves the right to verify any information submitted by a Panelist in their registration profile at any time. Such requests for verification may be made by email, phone, or U.S. mail. TSR further reserves the right to require that written or printed documentation be submitted promptly for verification of information in the profile, if requested. If any Panelist fails to provide verification when requested, and/or if any information in a Panelist’s profile is unable to be verified, such Panelist or Panelist household may be removed from the Panel without notice and may lose eligibility for future Activities and related incentives. In addition to the verification methods described above, all registrants are required to complete the identity verification process described in the “Identity Verification” section below before becoming Active Members.
Identity Verification
To help maintain the integrity of the Panel, prevent fraud, comply with applicable law, and ensure that incentives are issued to the correct individuals, all individuals who register with the Panel are required to complete an identity verification process before becoming Active Members. Identity verification is performed through a third-party identity verification provider, which may collect and process information including (but not limited to) your name, date of birth, address, government-issued identification document, and a photograph or biometric data used to: (i) verify your identity and authenticate you and your use of TSR services (such as a selfie used to compare to your identification document); (ii) detect and prevent fraud, (iii) evaluate the authenticity of images and identification documents, and (iv) improve and develop the identity verification services, where permitted by applicable law. The information you provide during identity verification is governed by these Terms and Conditions, the TSR Privacy Policy, and the terms and privacy policy of the third-party verification provider, which will be presented to you at the time of verification. TSR will obtain your consent to collect, store, and use any biometric data, as required by law.
For Panelist households (households with children), the parent or legal guardian who registers the household will complete identity verification on behalf of the household. Children do not undergo identity verification.
Until you successfully complete identity verification, you will not receive Activity invitations and you are not eligible to receive incentives. TSR reserves the right to deny, suspend, or terminate Membership based on the results of identity verification, including where verification is incomplete, fails, or returns results inconsistent with the information you provided during registration. TSR also reserves the right to require re-verification at any time, including in connection with suspected fraud, household changes, periodic re-verification, or as required by applicable law. Failure to complete re-verification when requested may result in suspension or termination of your Membership and forfeiture of any pending or unissued incentives.
TSR may use the results of identity verification, in combination with other information available to TSR, to determine eligibility, prevent fraud and duplicate participation, comply with tax reporting and other legal obligations, and as otherwise described in the TSR Privacy Policy.
Panel Participation and Incentives
As a Panelist, you may receive invitations from TSR, primarily by email, to participate in research activities such as online or in-person interviews, focus groups, diary studies, discussion boards, online research communities, usability tests, in-home studies, shop-alongs, mock trials, surveys, and other feedback sessions (each, an “Activity”). Participation in any Activity is voluntary, and there is no guarantee that you will be invited to any minimum number of Activities.
Each Activity invitation, sent to Active Members who have completed identity verification, will describe, where applicable, the nature of the Activity, approximate time commitment, eligibility criteria, and any incentive offered (for example, a digital reward link redeemable for an e-gift card). Incentive amounts and forms may vary by Activity and are determined in TSR’s sole discretion.
You will generally become eligible to receive an incentive only after TSR (and/or its Clients or vendors) confirms that you have fully and honestly completed the Activity and met all stated requirements, which may include attending all scheduled sessions, completing all required tasks, and passing quality and fraud checks. TSR reserves the right, in its sole discretion, to withhold, reduce, or cancel an incentive if TSR determines that your participation was incomplete, your responses were fraudulent, duplicative, inconsistent, or otherwise invalid, you violated these Terms and Conditions or any Activity-specific rules, or you are otherwise ineligible. TSR’s determinations in such matters are final, subject to the dispute review process described in the “Incentive Program” section.
Incentives are typically delivered digitally, for example by sending a reward link via email through a third-party incentive or gift-card provider. By participating in an Activity for which an incentive is offered, you consent to TSR sharing the minimum information necessary with such provider (such as your name and email address) for the purpose of incentive fulfillment. Additional terms may apply to the use of any reward link or e-gift card, and you agree to review and comply with the terms and conditions of the applicable incentive provider.
There is no points system, account balance, or redemption portal. Incentives are issued per qualifying Activity and are not accrued.
The Panel incentive program and its benefits are provided to you at the discretion of TSR and TSR has the right to terminate the program, or to change these Terms and Conditions, the incentives offered, or conditions of participation, in whole or in part, at any time, with or without notice to you. Such changes include changing or removing any incentives or Activities currently offered, at any time, with or without notice to you. If TSR does provide notice of changes, it may do so by email, postal mail, or by general posting on the Site.
Incentives for qualifying Activities are typically fulfilled within a reasonable period after TSR confirms eligibility, ranging from seconds to several weeks depending on the Activity and the third-party incentive provider. Reasonable effort is made to correctly issue incentives. However, Panelists are responsible for ensuring that any incentive owed has been received and for promptly notifying TSR of any missing, incorrect, or non-working incentive. If a Panelist does not notify TSR of a missing or incorrect incentive within a reasonable period (and in any event within thirty (30) days of the Activity), TSR has no further obligation to issue or replace that incentive.
Incentives do not require redemption from a points balance and are not accessed through a member portal. Incentive delivery is initiated by TSR following confirmation of qualifying participation in an Activity.
Only the registered Panelist (or, in the case of household Memberships, the primary household registrant) is eligible to receive incentives on behalf of the Panelist or household.
Bonus incentives may sometimes be offered to our more active Panelists in addition to periodic prize drawings among active Panelists. Additionally, incentives may be offered for referrals of qualified participants into the Panel. From time to time, TSR may, in its sole discretion, offer bonus incentives, referral incentives, sweepstakes, prize drawings, or other promotional opportunities to some or all Panelists, subject to separate rules communicated at the time of the offer.
TSR may change or remove any of the Activities or incentive opportunities currently offered, at any time, with or without notice to its Panelists. Incentives that Panelists earn are not considered property and cannot be sold, transferred, or assigned to any other person under any circumstances, except as expressly permitted by TSR.
TSR is not responsible for any lost, stolen or damaged incentives. Neither TSR nor its Clients are responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, or delayed emails, invitations, surveys, Activities, or incentives; or for lost, interrupted, or unavailable network, server, Internet Service Provider (ISP), Site, or other connections, availability or accessibility; miscommunications; failed computer, satellite, telephone, or cable transmissions, lines, or technical failure; jumbled, scrambled, delayed, or misdirected transmissions; computer hardware or software malfunctions, failures, or difficulties; other errors of any kind, whether human, mechanical, typographical, electronic, or network-relating to or in connection with the participation in the Panel, including, without limitation, errors which may occur in the administration of the Panel, the processing of surveys, or the issuance of incentives, or in any Panel-related materials. Neither TSR nor its Clients are responsible for any incorrect or inaccurate information, whether caused by Site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Panel. TSR reserves the right to void, reverse, or reclaim any incentive that has been incorrectly issued or duplicated — whether due to technical, computer, human, or other error — even if such error is not detected until after the incentive has been delivered to or used by the recipient. Use of automated entry devices or programs is prohibited. Each Panelist and their child(ren) and other participating household members agree that all disputes regarding Activities, eligibility, or incentives will be decided by TSR in its sole discretion, and such decisions are final. Panelists who believe a determination was made in error may submit a written explanation to TSR’s support team for further consideration; however, TSR retains final decision-making authority over all such matters. Pending or unissued incentives may be voided or forfeited if you cancel your Membership or violate these Terms and Conditions. The opportunity to receive incentives under the Panel does not entitle any Panelist to vested rights with respect to future Activities, incentives, or other benefits. TSR is not liable to you should it exercise its right to modify, suspend, or terminate the Panel incentive program or any part of it.
If you violate any law, rule, or regulation, including these Terms and Conditions, or if your participation in the Panel incentive program could violate any applicable state or federal law, rule, or regulation, TSR may refuse to register you, issue incentives, or may otherwise restrict, modify, or terminate your participation in the Panel.
Registration, User Name, and Password
Participation in Panelpolls Activities is primarily email-based and does not require you to log in to a member portal to view an incentive “balance.” Invitations, reminders, and incentive links are sent primarily via email and, where applicable, SMS. From time to time, TSR may make available limited features or tools that require a user name and password. Please read our Privacy Policy, which describes the Personal Information (as defined in our Privacy Policy) we collect, use, disclose, manage, and store. If we do provide such features, you will choose a user name and password (or we may assign an initial password which we will give you the option to change). Your user name and password are personal to you and you may not allow any others to use your user name or password under any circumstances. We are not liable for any harm caused or related to the theft or misappropriation of your user name or password or your authorization of anyone else to use your user name or password. You agree to immediately notify us if you become aware of or believe there is or may have been any unauthorized use of (or activity using) your user name or password or any other need to deactivate your user name or password due to security concerns.
Here are some commitments you make to us relating to registering and maintaining the security of your Panelist record:
- You will not provide any false personal information on the TSR Panel, or register for anyone other than yourself.
- You will not register for the TSR Panel if you are under 18; children under 18 may only participate through a parent or legal guardian’s household Membership, with verifiable parental consent as required by applicable law.
- You will not use the TSR Panel if you are a convicted sex offender.
- You will keep your contact information accurate and up-to-date.
- You will not share your password (if applicable), let anyone else access your Panelist record, or do anything else that might jeopardize the security of your Membership.
SMS Text Messaging & Alerts Terms
TSR does not currently operate a mass SMS alerts or notifications program. From time to time, a TSR recruiter or research coordinator may contact you by SMS on an individual basis regarding a specific Activity — for example, to schedule a session, remind you of an appointment, or follow up on your participation. Such one-to-one SMS communications are sent only to Panelists whose participation is being actively coordinated and only to the mobile phone number the Panelist has provided to TSR for that purpose. SMS text messaging is optional and your consent to receive text messages is not required to participate in the Panel.
TSR reserves the right to launch a mass SMS alerts or notifications program in the future. Any such program will include a separate enrollment and consent flow, and your enrollment in any such program will not occur automatically based on your existing Panel Membership.
Authorization: You certify that you are authorized: (a) to be contacted by TSR or its recruiters at the mobile phone number you have provided, and (b) to incur any mobile message or data charges that may be incurred in connection with such SMS communications.
Frequency of Messages: The number of text messages you may receive per month may vary depending on the number of research activities you qualify for at any given time—from several messages to 10+ messages per month.
To Stop Messages: If you wish to stop receiving SMS messages from a TSR recruiter, you may reply “STOP” to the recruiter’s message or contact TSR using the information in the “Contact Us” section below. TSR will process your request within a reasonable period and will not send further SMS messages except as necessary to confirm your opt-out or to address outstanding matters related to an Activity in which you were participating.
For help or questions regarding SMS communications from TSR, please contact us using the information in the “Contact Us” section below.
Message, Voice, and Data rates may apply. By receiving SMS communications from TSR or its recruiters, you approve any such charges from your mobile carrier. Check your carrier’s plan for details. You acknowledge and agree that you are solely responsible and liable for obtaining, maintaining, and paying all charges related to your mobile device(s).
No Guarantee: TSR is not responsible for incomplete, lost, late, or misdirected messages, including (but not limited to) undelivered messages resulting from any form of filtering by your mobile carrier or service provider or otherwise.
Use of Automated Dialing Technology: You acknowledge and agree that SMS communications from TSR or its recruiters may be sent (in some cases) through automatic telephone dialing technology, an artificial voice or, a pre-recorded voice, or similar technology. The Federal Communications Commission defines an “automatic telephone dialing system” or autodialer as equipment that has the capacity to store or produce telephone numbers to be called and to call such numbers. 47 C.F.R. § 64.1200. By providing us your phone number, you expressly consent to receive such SMS communications through automatic dialing technology, artificial and, or pre-recorded voice.
General Communications: You agree to receive notifications from TSR, its representatives, employees, and agents, through any means authorized under this Agreement, including phone calls and text messages that use automatic telephone dialing technology, artificial voice or pre-recorded voice or live person.
Termination: TSR reserves the right, in its sole discretion, to cancel or suspend any or all of its SMS communications, in whole or in part, for any reason, with or without notice to you.
Email Communications
By joining the Panel, you consent to receive email communications from TSR and its service providers regarding Panel Membership, Activity invitations, reminders, follow-up questions, incentive fulfillment, and related support. Each research invitation or marketing email will include a clear unsubscribe or opt-out mechanism or reply instruction. If you choose to unsubscribe using that mechanism or by contacting us directly, TSR will process your request as soon as reasonably practicable, and in any event will stop sending you such emails within ten (10) business days. You may still receive transactional or non-marketing emails related to outstanding obligations (for example, pending incentive fulfillment or legal notices).
Notification of Changes in Personal & Other Information
You agree as a Member to promptly notify TSR of any changes in personal and other information including but not limited to name, address, phone number, e-mail address, and demographic information. You may provide such updates by replying directly to a Panel email, by contacting TSR at the email or mailing address set forth in the “Contact Us” section below, or, where available, by using any profile or preference tools that TSR provides.
Rules of Conduct
Your use of the Site or participation in the Panel or any Activity is subject to all applicable local, state, and national laws and regulations and, in some cases, international treaties. You are solely responsible for all activities, acts, and omissions that occur in, from, through, or under your user name or password or in connection with your Panel Membership or any Activity in which you participate. You shall not use, allow, or enable others to use the Site or to participate in the Panel or any Activity on your behalf or through your Panel Membership, or knowingly condone use of the Site or participation in the Panel or any Activity by others, in any manner that is, attempts to be, or is likely to be:
- libelous, defamatory, indecent, vulgar or obscene, pornographic, sexually explicit or sexually suggestive, racially, culturally, or ethnically offensive, harmful, harassing, intimidating, threatening, hateful, objectionable, discriminatory, or abusive, or impersonating anyone else;
- adverse to us or reflective negatively on us, the Site, our goodwill, name, or reputation, or cause duress, distress, or discomfort to TSR or its Client(s) or anyone else, or discourage any person, firm, or enterprise from using all or any portion, features, or functions of the Site, or from advertising, linking, or becoming a supplier to us in connection with the Site;
- except with regard to users that are TSR Clients, used for commercial or business purposes, including, without limitation, advertising, marketing, or offering goods or services, whether or not for financial or any other form of compensation or through linking with any other Site or web pages;
- used to transmit, distribute, or upload programs or material that contain malicious code, such as viruses, worms, trojan horses, spyware, or other potentially harmful programs or other material or information;
- in violation of any laws, regulations (including, without limitation, laws regarding the transmission of technical data or software exported from the United States), judicial or governmental order or any treaties, or that violates or infringes upon any intellectual property rights, rights of publicity or privacy, or any other rights of ours or of any other person, firm, or enterprise; used to gain unauthorized access to the Site, other users’ accounts, names, passwords, personally identifiable information, or other computers, Websites, or pages connected or linked to the Site, or to use the Site in any manner which violates or is inconsistent with this Agreement;
- used to modify, disrupt, impair, alter, or interfere with the use, features, functions, operation, or maintenance of the Site or the rights of use and enjoyment of the Site by any other person, firm, or enterprise; or
- used to collect, obtain, compile, gather, transmit, reproduce, delete, revise, view, or display any material or information, whether personally identifiable or not, posted by or concerning any other person, firm, or enterprise, in connection with their or your use of the Site, unless you have obtained the express, prior permission of such other person, firm, or enterprise to do so.
In addition, the following rules shall apply to the Site: the Site shall be accessible to Members only; all Members shall keep postings and any information that we make available confidential; and you agree not to copy or download any copyrighted material.
Zero Tolerance of Abuse or Fraud
You agree to abide by and not abuse your benefits and privileges as a TSR Panel Member. Such abuses include, but are not limited to, attempts to qualify for, receive, or use incentives in any manner that conflicts with the intent of this Agreement or any Activity-specific rules communicated to you. Other examples include, but are not limited to, any fraudulent methods for qualifying for or receiving incentives, creating duplicate or false accounts, tampering with surveys or links, using bots or automated tools, or providing dishonest or contradictory responses, submitting false, altered, AI-generated, manipulated, or another person’s identification documents during the identity verification process, or having any other person complete identity verification on your behalf; using virtual private networks (VPNs), proxy servers, anonymizing services, or other technology to conceal your real identity, residence, or location for purposes of registering with or participating in the Panel; using single-use, temporary, virtual, or non-personal mobile phone numbers or email addresses to register or participate; or otherwise circumventing or attempting to circumvent the Panel’s identity, eligibility, or fraud-prevention controls. You also agree not to perform any Activity in an artificial, engineered, or unauthorized manner, or to engage with the Panel or any Activity in a manner that does not reflect organic, conventional human usage. Prohibited conduct includes, without limitation, participating in a botnet, click farm, or other automated or coordinated fraud collective; manipulating links; or using any automated, artificial intelligence, machine learning, or similar technology to generate, draft, paraphrase, or otherwise compose responses to surveys, interviews, focus group questions, diary studies, or other Activity content. Activity responses must be your own original responses based on your actual experiences, opinions, and views.
TSR shall be the sole determiner in cases of suspected abuse, fraud, or violation of its rules, and any decision made shall be final and binding, including with respect to whether incentives are issued for an Activity (subject to the dispute review process described in the “Incentive Program” section). Fraud or abuse relating to participation in Activities or receipt of incentives may result in the withholding, reversal, or forfeiture of any incentives associated with the affected Activities as well as the termination of your participation in the TSR Panel.
We do our best to keep the TSR Panel safe, but we cannot guarantee it. We need your help to do that, which includes the following commitments:
- You will not send or otherwise post unauthorized commercial communications (such as spam) on the TSR Panel.
- You will not collect users’ content or information, or otherwise access the TSR Panel, using automated means (such as harvesting bots, robots, spiders, or scrapers).
- You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on the TSR Panel.
- You will not upload viruses or other malicious code.
- You will not solicit login information or access an account belonging to someone else.
- You will not do anything that could disable, overburden, or impair the proper working of the TSR Panel, such as a denial of service attack.
- You will not facilitate or encourage any violations of the Terms and Conditions.
Notification of Unauthorized Use
You agree to maintain your password and other information confidential to prevent unauthorized use of your Membership. It’s also your responsibility to notify us promptly of any improper uses of your Membership. You are solely responsible for any loss of incentives, or other fraudulent activities associated with sharing your password or permitting others to access your communications.
Membership Cancellation
Membership is solely at the discretion of TSR. TSR reserves the right to refuse to offer, register, or provide Membership or other services to anyone, at any time, in its sole discretion. Membership is voluntary and may be terminated at will by either party. There is no obligation or requirement to remain a Member of the TSR Panel. You may terminate your Membership at any time by using the unsubscribe or opt-out link provided in Panel emails, by replying to a Panel email with a request to unsubscribe, or by contacting us directly (see the “Contact Us” section below). Once your Membership is cancelled, TSR will stop sending you Panel invitations and related communications within a reasonable period, subject to processing times. Incentives that have already been issued to you are not affected; however, you may no longer be eligible to receive incentives for any Activity you do not complete prior to cancellation.
Suspension & Termination
TSR reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Panel (or any part of it) with or without notice. The Panel may be dissolved for any reason, without notice, at any time, solely at the discretion of TSR. You agree that TSR and its Client(s) shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Panel. You agree that TSR, in its sole discretion, may suspend or terminate your Membership (or any part of it), remove and discard any profile information, and withhold or cancel any unissued incentives, for any reason or for no reason, including, without limitation, for lack of use, or for violating the letter or the spirit of these Terms and Conditions. We may immediately issue a warning, temporarily suspend, indefinitely suspend, or terminate your Membership if you breach these Terms and Conditions. You agree that any termination of your access to the Panel may be immediate and without prior notice. You further agree that TSR and its Client(s) shall not be liable to you or any third party for any termination of your use or ability to access the Panel.
Specific reasons for such limitation or termination include, but are not limited to, the following: (a) TSR requires all Panelists to update their profile and registration information promptly whenever there are any changes including, but not limited to, e-mail address and demographic information. Failure to promptly notify TSR of any changes in personal or other information or to respond to TSR’s request for such updates shall result in the applicable Panelist being removed from the Panel, such Panelist information being deleted from TSR’s records, and the loss of eligibility for future Activities and incentives; (b) using in the registration of your TSR Membership an email account that is not your own or that is or becomes inactive; (c) failing to designate the Panel email address as an approved sender to prevent Panel emails being rejected as spam; (d) taking action that results in, or might result in, our email being designated as spam; (e) blocking or rejecting our emails; (f) length of participation exceeding the desired length; (g) falsifying information in your registration or household profile; (h) inactivity, meaning if any Panelist does not participate in Panel activities for more than six (6) months, his or her household shall be deemed to have abandoned the Panel, and TSR shall be entitled, without notice or any obligation to such Panelist (or their household), to remove such Panelist household from the Panel and delete such Panel household information from its records, and cancel any pending or unissued incentives; (i) registering more than once; (j) reproducing, distributing, republishing, or retransmitting any material contained in a survey or in any Activity; and (k) any other conduct that violates the Rules of Conduct, abuses, and commitments described in these Terms and Conditions. TSR reserves the right to take any action it deems necessary with respect to your Panel or user account if we have reason to believe it may cause us to lose the services of our ISP, suppliers, or be harmful to our Clients or other Panelists.
ANY ATTEMPT TO DAMAGE THE PANEL OR TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE PANEL IS A VIOLATION OF THE TERMS AND CONDITIONS FOR USE OF THE PANEL, AS WELL AS CRIMINAL AND CIVIL LAWS. SHOULD TSR BELIEVE OR BECOME AWARE THAT SUCH AN ATTEMPT HAS BEEN, IS BEING, OR WILL BE MADE, TSR RESERVES THE RIGHT TO REMOVE ANY RESPONSIBLE PANELIST FROM THE PANEL AND CANCEL ANY UNISSUED INCENTIVES ASSOCIATED WITH THE OFFENDING ACTIVITY, AND SEEK REMEDIES AND DAMAGES FROM ANY RESPONSIBLE MEMBER AND OTHER RESPONSIBLE INDIVIDUAL(S) TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING WITHOUT LIMITATION CRIMINAL PROSECUTION.
Liability Excluded; Limitation of Liability
By accessing this Site and/or participating in the Panel, you agree that TSR and its Client(s) will not be liable for any loss and/or damages whatsoever you may suffer and, in particular, TSR and its Client(s) will not be liable for special, consequential, or incidental damages or damages for loss of profits, loss of revenue, or loss of use, arising out of or in connection with this Site or the information or material contained in it, whether any claim is brought in contract, tort (including negligence), or otherwise.
TSR and its Client(s) shall in no event be liable for the loss of profits, goodwill, or other special or consequential damages suffered by any Members or others as a result of performance or non-performance by TSR and its Client(s) under this Agreement whether or not the possibility of such damages was disclosed to TSR and its Client(s) or could have been reasonably foreseen by TSR and its Client(s).
TSR and its Client(s) are neither responsible nor liable for any damages, whether direct, indirect, incidental, special, or consequential, or losses that result from participation in the surveys or other Panel activities offered to Members, or from reliance on or use of information, services, or merchandise provided on or through the Panel, except where such liability is mandated by law.
You further acknowledge that TSR and its Client(s) neither endorse the contents of advertisements or partner websites, nor assume responsibility or liability for the accuracy of material contained therein, or any infringement of third-party intellectual property rights arising therefrom, or any fraud or other crime facilitated thereby.
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAWS, YOU ACKNOWLEDGE AND AGREE THAT IN NO EVENT WILL TSR AND ITS CLIENT(S) BE LIABLE, OR OTHERWISE RESPONSIBLE, TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL AND/OR PUNITIVE DAMAGES, ARISING OUT OF, RESULTING FROM, IN CONNECTION WITH, OR CAUSED BY, WHETHER DIRECTLY OR INDIRECTLY, (i) YOUR PANEL MEMBERSHIP; (ii) YOUR RELIANCE ON, OR USE OF, ANY INFORMATION, SERVICES AND/OR MERCHANDISE PROVIDED BY, ON, OR THROUGH ANY WEBSITE(S); AND/OR (iii) YOUR/YOUR HOUSEHOLD PARTICIPATION IN ANY SURVEY(S) OR OTHER PANEL ACTIVITIES OFFERED, PROVIDED, HOSTED, OR ADMINISTERED BY TSR AND ITS CLIENT(S) AND/OR ITS OR THEIR EMPLOYEES AND/OR AGENTS, REGARDLESS OF WHETHER TSR AND ITS CLIENT(S) ARE INFORMED OF THE POSSIBILITY THE SAME MAY EXIST.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TSR’S AND ITS CLIENTS’ AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH YOUR PANEL MEMBERSHIP, PARTICIPATION IN ACTIVITIES, AND ANY INCENTIVES YOU RECEIVE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL VALUE OF INCENTIVES ISSUED TO YOU BY TSR IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THIS LIMITATION DOES NOT APPLY TO LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR OTHER LIABILITY WHICH CANNOT BE LIMITED BY LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Intellectual Property Rights & Using Our Property
The names, logos, icons, and graphics used on this Site in connection with or identifying the products and/or services of TSR or its Clients are proprietary marks of TSR and/or its Clients, and any other content or material embodying or consisting of patentable or copyrightable work on the Site are proprietary marks of TSR and its Client(s), as applicable. Your access does not imply a license to reproduce, transmit, and/or distribute this information or these names, logos, icons, and graphics in any form or by any means. If you wish to do any of these things you must first obtain prior written consent from TSR and/or its Clients as applicable. Except with regard to users that are TSR Clients, the content of the Panel and Site is intended for the personal, noncommercial use of its users, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content, including TSR or its Clients’ intellectual property.
In addition to works of TSR and its Client(s), this Site and the Panel surveys or other research Activities also contain matter covered by copyright and owned by third parties or assigned to and owned by TSR and/or its Client(s). Additionally, this Site and the Panel surveys and other research Activities contain trademarks and other intellectual property owned by TSR and/or its Client(s) or owned by third parties and licensed to TSR and/or its Client(s). You should not assume anything on this Site or in any of the Panel surveys or other research Activities is necessarily in the public domain.
All pages and content within the Site and any related surveys or other research Activities including but not limited to, text, graphics, audio, video, photographs, surveys, logos, or other materials are the intellectual property of, or are authorized for use by, TSR and/or its Clients, licensors, business partners, and/or affiliates, including all trademarks, service marks, copyrights, patents, and trade secrets contained therein. You are hereby expressly prohibited from modifying, copying, reproducing, creating derivative works of, republishing, displaying, uploading, posting, transmitting, or distributing, in any way, the content available on the Site, without the prior written consent of TSR or its Client(s), as applicable, which may be granted or withheld in the sole discretion of TSR and/or its Clients, licensors, business partners, and/or affiliates.
Indemnification
Each Panel Member agrees to indemnify, defend, and hold harmless TSR and its Client(s), vendors, and their respective parents, subsidiaries, and affiliated companies, and each of their respective officers, directors, employees, agents, and representatives, from and against any and all claims relating to the use of the Site or participation in the Panel or any Activity or a breach by such Panel Member (or their family member or child(ren) in the case of household memberships) of any representations, warranties, terms and conditions, or agreements made in this Agreement or elsewhere on this Site. You accept all responsibility for, and hereby indemnify and hold harmless TSR and its Client(s), its and their representatives, officers, agents, directors, and employees from and against, any actions taken by any user authorized to use your Membership, including but not limited to responses to surveys offered or participation in any Activity, receipt of incentives, and disclosure of passwords to third parties. You further agree to indemnify and hold TSR and its Client(s), its and their representatives, officers, agents, directors, and employees harmless from any claim, demand, expense, or damage, including reasonable attorneys’ fees, relating to use of any Panel, incentives, and intentional or negligent abuse or violation of this Agreement.
Governing Law and Dispute Resolution
This Agreement, together with any Additional Terms, Rules, our Privacy Policy, and any other regulations, procedures, and policies which we refer to and which are hereby incorporated by reference, contains the entire understanding and agreement between you and the Site and supersedes any and all prior understandings relating to the Site and your use of the Site. This Agreement cannot be changed or terminated orally. If any provision of this Agreement is held to be illegal, invalid, or unenforceable, this will not affect any other provisions and the Agreement will be deemed amended to the extent necessary to make it legal, valid, and enforceable. The following provisions shall survive the termination or expiration of this Agreement or your Membership: Confidential Information, Intellectual Property Rights, Indemnification, Limitation of Liability, Governing Law and Dispute Resolution (including the binding arbitration provision, class action waiver, and opt-out right), Privacy, and any other provision that by its nature is intended to survive.
Informal Dispute Resolution. Before filing any claim, you agree to attempt to resolve the dispute informally by contacting TSR at the address or email in the “Contact Us” section below and allowing TSR at least thirty (30) days to respond and attempt to resolve the matter.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to this Agreement, your Membership, your participation in any Activity, or any incentive (collectively, “Disputes”), that is not resolved through the informal process described above shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information. The arbitration shall take place in New York, New York, or, at your election, by telephone or videoconference. The arbitrator shall apply New York law consistent with the Federal Arbitration Act. Judgment on any arbitral award may be entered in any court of competent jurisdiction.
Class Action Waiver. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND TSR EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND IN ANY FORUM. YOU AND TSR AGREE THAT ANY DISPUTE WILL BE RESOLVED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. If this class action waiver is found to be unenforceable as to a particular claim or request for relief, then that claim or request for relief shall be severed and proceed in a court of competent jurisdiction rather than in arbitration, while all remaining claims shall continue to be arbitrated.
Opt-Out Right. You may opt out of this arbitration provision and class action waiver by sending written notice to TSR at the address in the “Contact Us” section within thirty (30) days of first accepting these Terms and Conditions. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, either party may pursue claims in a court of competent jurisdiction as set forth in these Terms and Conditions.
These Terms and Conditions are governed, construed, and enforceable in accordance with the laws of the State of New York. Subject to the binding arbitration and class action waiver provisions above, and, for the purposes of any legal or equitable action not subject to arbitration, you agree and submit to the exclusive jurisdiction and venue of the State and Federal Courts situated in New York City, New York, and agree you will not object to such jurisdiction or venue on the grounds of lack of personal jurisdiction, forum non conveniens, or otherwise. To the extent it may be applicable, you agree to opt out from and expressly exclude any applicability of the Uniform Computer Information Transactions Act. IN ANY ACTION OR PROCEEDING COMMENCED TO ENFORCE ANY RIGHT OR OBLIGATION OF THE PARTIES UNDER THIS AGREEMENT, YOUR USE OF THE SITE, OR WITH RESPECT TO THE SUBJECT MATTER HEREOF, YOU HEREBY WAIVE ANY RIGHT YOU MAY NOW HAVE OR HEREAFTER POSSESS TO A TRIAL BY JURY.

By registering for the Panel as a parent or legal guardian, you:

By registering and/or submitting any personally identifiable information such as your email address, name, or postal address, you are warranting that you are 18 years of age or older.
- Complete the identity verification process described in the “Identity Verification” section above, on behalf of the Panelist household.
- You warrant and represent that neither you nor your child(ren) shall: (i) have registered through any unapproved method; (ii) have registered more than once and/or have provided false or incorrect registration information; (iii) tamper with the operation of the Site; (iv) be in violation of the Site’s Terms of Service, Privacy Policy, Panelist Agreement, or other terms, conditions, or guidelines; (v) act in bad faith, or in a non-sportsmanlike or disruptive manner in connection with your use of the Site or participation in the Panel; or (vi) annoy, abuse, threaten, or harass any other person in connection with your use of the Site or participation in the Panel.
For research involving children, TSR obtains verifiable parental consent in accordance with COPPA and other applicable U.S. privacy laws. Parents or legal guardians may, at any time, review the Personal Information collected from their child, request that TSR delete it, or withdraw consent to further collection or use by contacting TSR using the information in the “Contact Us” section below.

You are prohibited from encouraging, coaching, and/or advising any individual, including, without limitation, any TSR employee, to commit any act(s) prohibited hereunder. You acknowledge and agree that TSR will fully cooperate with any law enforcement authorities or court order, within the limits of all applicable laws, requesting or directing TSR to disclose or reveal the identity of anyone posting any such information or materials or using the Sitein violation of these Terms and Conditions. The prohibitions in this section apply equally to your participation in the Panel and any Activity, and any conduct described above (or any analogous conduct) undertaken in connection with an Activity is likewise prohibited.
Confidential Information
During the course of your participation in the Panel, it likely will be appropriate for you to have access to some of TSR’s or its Clients’ proprietary and confidential information, including by way of example and without limitation both TSR’s and its Clients’ products, product ideas, concepts, concept descriptions, imagery, photographs, drawings, software, music, games, designs, plans and timetables, product formula and specifications, processes, pricing and financial information, in documentary, oral, and electronic form (hereinafter “Information”).
- You hereby expressly agree to hold in confidence any portion of the Information received during your, or other household members’, participation in the Panel which is not, or does not become, generally available to the public, and will neither use, nor disclose to others, this Information without TSR’s or its Clients’ express written consent.
- You acknowledge that all Panel surveys and associated survey materials (and other Activities and associated Activity materials) and Information are the proprietary and confidential property of TSR’s and its Clients’. You hereby expressly agree that neither you nor any member of your household or immediate family will print, copy, capture, screenshot, record, or otherwise reproduce or distribute any part of any survey or Activity, including, but not limited to, survey questions, topics, photographs, images, drawings, products, product ideas, concepts, concept descriptions, text, or other associated materials, including but not limited to survey invitations, survey links, or URLs (or Activity invitations, Activity links, or URLs); nor will you or they transmit or disseminate any of said survey information or materials to anyone for any reason except as part of an approved Panelist activity (for example, survey links or URLs may be forwarded to Panelist family household members as needed for them to participate, as authorized, in the surveys, or as otherwise approved by TSR). Without limiting the foregoing, you agree not to post, share, or discuss any study materials or your responses on social media, review sites, or other public or private forums.
- You further agree that you will not share, distribute, or disclose Activity screening criteria, qualifying questions, answers, or other Activity-related information with or to other Panelists or third parties, and you will not coach, assist, advise, or otherwise help any other person to qualify for, participate in, or complete any Activity. This includes, without limitation, posting Activity-related information on online forums, social media, panelist communities, or other public or private channels where other Panelists or potential Panelists may access it.
- You also agree that the commitment to hold TSR’s and Clients’ Information in confidence will extend beyond any termination of this Agreement and will remain in effect until such Information becomes generally available to the public.
Incentives & Taxes
TSR does not provide any legal or tax advice to Panelists. Panelists are solely liable and responsible for their own tax and legal obligations. TSR may provide you and/or the appropriate government agency or taxing authority with information related to your incentive history, and, if applicable, TSR may withhold taxes upon request from the appropriate government agency or taxing authority. You acknowledge that TSR may be required to provide or supply certain information to applicable government agencies or departments in regards to any payments or incentives you earn in connection with your use of TSR’s Sites or services. You acknowledge that TSR may supply information to taxing agencies, or withhold taxes, at the request of those agencies or as we, in our sole discretion, deem appropriate. You agree to provide TSR with all required information to assist TSR in complying with its reporting or withholding obligations. Your failure to provide such information within thirty (30) days of a request sent by TSR to the email address registered at that time may result in the forfeiture of pending or unissued incentives and TSR shall be entitled, without notice or any obligation to such Panelist (or their household), to remove such Panelist household from the Panel, delete such Panel household information from its records, and cancel any pending incentives.
Submissions
All information, including, without limitation, comments, ideas, graphics, or other materials submitted by you or your child(ren), or other household member, to TSR or its Clients through the Site (but excluding registration information) or through any surveys or other Panel activity (“Submissions”) may be used or published by TSR or its Clients in any way and for any purpose, in any and all media, now or hereafter discovered, throughout the world and in perpetuity, and without restriction, permission, notification, or compensation to you or other household member, to the extent permitted by law. Without limiting the foregoing, all survey responses, discussion-board posts, multimedia submissions, and other Submissions may be used by TSR and its Clients for analysis, reporting, and product or service development without additional compensation to you beyond the incentive (if any) expressly offered for the applicable Activity. All Submissions must be original, accurate, and in keeping with the image of TSR or its Clients and may not be offensive, as determined by TSR in its sole discretion. No Submissions shall defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or any property rights or any other third party rights (including, without limitation, intellectual property rights). You agree that you are not entitled to any additional compensation or ownership in any products, services, reports, or other outputs developed using your Submissions, beyond any incentive expressly offered for the Activity in which you participated.
Postings
Your comments, suggestions, and information are important to us. To the extent TSR makes available message, community, discussion board, or similar features that allow Panelists to submit, post, display, transmit, or exchange (a) information, ideas, opinions, messages, or other information (“Post” or “Postings”) and (b) user content, the following rules apply. Your submission of any such content is also governed by these Terms and Conditions, and any such content is considered a Posting for purposes herein. You understand, acknowledge, and agree that such Postings are the sole responsibility of the person from which such Postings originated. This means that you are solely and entirely responsible for the consequences of all Postings that you upload, post, email, transmit, or otherwise make available via the Site. Postings do not reflect the views of the Site, TSR or its Client(s), or its or their parent companies or affiliates. We and our Clients reserve the right to monitor, edit, or screen any Postings. If we or our Clients determine, in our or their sole discretion and judgment, that any Posting does or may violate any of the terms of this Agreement, we reserve the right, at any time and without limiting any and all other rights we may have under this Agreement, at law or in equity, to: (a) refuse to allow you to Post; (b) remove and delete Postings; (c) revoke your right to use the Site; and/or (d) use any technological, legal, operational, or other means available to us to enforce the provisions of this Agreement, including, without limitation, blocking specific IP addresses or deactivating your registration on the Site.
To the extent permitted by law, all Postings are considered works made for hire, with TSR and its Clients as the author and initial owner of all rights therein. If, for any reason, any such rights do not automatically vest in TSR or its Clients, you hereby assign and transfer all such rights to TSR and its Clients.
To the extent any community, discussion board, or other Posting feature is made available on the Site or as part of an Activity, all Postings are subject to these Terms and Conditions, and TSR and its Clients retain the same rights to monitor, edit, screen, remove, or take enforcement action with respect to any such Posting as described above. References in these Terms and Conditions to “incentives” shall apply to any incentive offered in connection with community or Posting participation, and no Posting or community participation entitles a Panelist to any additional compensation beyond any incentive expressly offered for the applicable Activity.
